二、申請(qǐng)人的資格要求

投標(biāo)人應(yīng)當(dāng)具備下列條件：

Bidders shall satisfy the following conditions:

（1）投標(biāo)人應(yīng)為在中國(guó)境外合法設(shè)立的律師事務(wù)所（含在港澳臺(tái)地區(qū)注冊(cè)的律師事務(wù)所）。投標(biāo)人不得以其駐華代表機(jī)構(gòu)的名義投標(biāo)，但可通過(guò)其駐華代表機(jī)構(gòu)辦理相關(guān)事宜；

(1) Bidders shall be law firms legally established outside the territory of China (including law firms registered in the Hong Kong Special Administrative Region, the Macao Special Administrative Region, or the Taiwan Region). A bidder shall not submit its bid in the name of its representative office in China, but can deal with relevant matters through its representative office；

（2）具有良好的商業(yè)信譽(yù)和健全的財(cái)務(wù)會(huì)計(jì)制度；

(2) Having a good business reputation and sound financial and accounting systems；

（3）具有承辦委托法律服務(wù)事項(xiàng)的團(tuán)隊(duì)和能力；

(3) Having a team with the ability to undertake the entrusted legal services；

（4）已購(gòu)買本項(xiàng)目招標(biāo)文件。

投標(biāo)人在平臺(tái)下載投標(biāo)文件編制軟件進(jìn)行投標(biāo)文件編制，投標(biāo)文件編制完成后，使用CA進(jìn)行投標(biāo)文件的加蓋簽章，并將加蓋簽章的投標(biāo)文件加密導(dǎo)出后上傳，最后使用CA進(jìn)行開標(biāo)截止時(shí)間后的解密。

Bidders should download their bidding document software on the platform, and prepare their bids. All the bids should be sealed using CA, encrypted, exported and uploaded; and the bids should be decrypted after the bid opening deadline.

本項(xiàng)目將通過(guò)中國(guó)通用招標(biāo)網(wǎng)（www.china-tender.com.cn）電子招標(biāo)平臺(tái)（以下簡(jiǎn)稱“本平臺(tái)”）進(jìn)行網(wǎng)上全流程招投標(biāo)，有意向的投標(biāo)人須在平臺(tái)注冊(cè)后辦理CA電子證書。辦理CA電子證書后，也可以使用CA電子證書參加在本平臺(tái)進(jìn)行的其他全流程招投標(biāo)項(xiàng)目，因其他項(xiàng)目辦理過(guò)本平臺(tái)CA鎖的，如CA鎖還在有效期內(nèi)，則可直接使用。

The whole-process bidding will be conducted online through the electronic bidding platform of China General Tendering Website (www.china-tender.com.cn) (hereinafter referred to as the "Platform"). Interested bidders shall apply for an e-certificate(CA)after registration on the platform, which is also applicable in other whole-process bidding projects on the platform. If a CA lock is required in other projects, this CA lock, if valid, is applicable.

3）售價(jià)：投標(biāo)人可選擇按項(xiàng)目或按年度辦理，選擇按項(xiàng)目辦理的費(fèi)用為500元人民幣或80美元或70歐元；選擇按年度辦理的，費(fèi)用為800元人民幣或110美元或100歐元，可在有效期內(nèi)參與平臺(tái)的其他全電子項(xiàng)目，售后不退。

3) Price: Bidders can choose to process on a project-by-project or year-by-year basis. The cost is CNY500 or USD80 or EUR70 if they choose to process on a project-by-project basis; or CNY800 or USD110 or EUR100 if they choose to process on a year-by-year basis. The bidders are allowed to participate in other all-electronic projects of the platform during the period of validity, and the sale price is non-refundable.

1.政府采購(gòu)政策：（不適用）1. The government's procurement policy: (not applicable).

（1）鼓勵(lì)節(jié)能政策：在技術(shù)、服務(wù)等指標(biāo)同等條件下，優(yōu)先采購(gòu)屬于國(guó)家公布的節(jié)能品目清單中產(chǎn)品。      (1) Policy of encouraging energy conservation: under the same conditions of technology and service, the products in the list of energy-saving items published by the state shall be preferentially purchased.

（2）鼓勵(lì)環(huán)保政策：在性能、技術(shù)、服務(wù)等指標(biāo)同等條件下，優(yōu)先采購(gòu)國(guó)家公布的環(huán)保產(chǎn)品品目清單中的產(chǎn)品。     (2) Policy of encouraging environmental protection: under the same conditions of performance, technology and service, give priority to purchasing products in the list of environmental protection products published by the state.

（3）扶持中小企業(yè)政策：貨物和服務(wù)項(xiàng)目評(píng)審時(shí)小型和微型企業(yè)產(chǎn)品享受10%的價(jià)格折扣，用扣除后的價(jià)格參加評(píng)審；工程項(xiàng)目評(píng)審時(shí)小型和微型企業(yè)在采用原報(bào)價(jià)進(jìn)行評(píng)分的基礎(chǔ)上增加其價(jià)格得分的3%。     (3) Policy of supporting small and medium-sized enterprises: when evaluating goods and services items, products from small and micro enterprises shall enjoy a price discount of 6%, and shall participate in the evaluation with the deducted price; during the project evaluation, on the basis of adopting the original quotation for scoring, scoring of small and micro enterprises shall be increased by 3% of the price scores.

（4）投標(biāo)產(chǎn)品不得為進(jìn)口產(chǎn)品。(4) The bidding products shall not be imported products.

（5）本項(xiàng)目鼓勵(lì)節(jié)能產(chǎn)品、環(huán)保產(chǎn)品和中小企業(yè)投標(biāo)（監(jiān)獄企業(yè)、殘疾人福利性單位視同小型、微型企業(yè)）的具體辦法詳見(jiàn)第三章評(píng)標(biāo)辦法。與第三章評(píng)標(biāo)辦法內(nèi)容不一致的，以第三章評(píng)標(biāo)辦法規(guī)定為準(zhǔn)。     (5) For specific measures for encouraging bidding of energy-saving products, environmental protection products and small and medium-sized enterprises in this project (prison enterprises and welfare units for the disabled are regarded as small and micro enterprises), please refer to Chapter III Bid Evaluation Measures for details. In case of any inconsistency with the contents of Chapter III Bid Evaluation Measures, the provisions of Chapter III Measures shall prevail.
